يمثل سريان الحكم الصادر بعدم الدستورية من حيث الزمان إشكالية قانونية وعملية، فقد حاولت مختلف الأنظمة القانونية مواجهتها بوسائل عديدة، بالنظر إلى انعكاساتها الكثيرة في شتى نواحي الحياة، إلا ان مسألة تحديد النطاق الزمني لا تثير أي مشاكل قانونية في حال عدم قبول الدعوى الدستورية أو رفضها كونها لا تمس دستورية النص محل الطعن. و قد يثار التساؤل عن الوقت الذي يخرج فيه القانون المحكوم بعدم دستوريته من دائرة النظام القانوني للدولة، فهل يخرج هذا القانون من اليوم التالي لنشر الحكم في الجريدة الرسمية، أم من يوم صدوره؟ ومن ثم فإنه يعد كأنه لم يصدر أصلا و من ثم تلغى جميع الآثار القانونية المترتبة عليه منذ تاريخ العمل به.
